Casey’s Lawyers Ask Judge to Dismiss Claims

As Casey Anthony’s bankruptcy proceedings enter their 10th month (she filed in January), she asked a judge Thursday to dismiss Roy Kronk and Zenaida Gonzalez’s claims in her bankruptcy case, saying they are without merit.  Both Zenaida Gonzaelz and Roy Kronk claim Anthony defamed them and they should be considered creditors in the bankruptcy case.  Anthony asked in the dual motions for the “fresh start” she is promised by law.

“This travesty has gone on long enough,” Anthony’s lawyers argue in both new motions, “Ms. Anthony implores the Court to end this matter so she can begin the fresh start she is promised by the law.”

Casey Anthony told detectives during a 2008 investigation that a woman named Zenaida Fernandez Gonzalez, her nanny for 2 years, kidnapped her 2-year-old daughter.  Gonzalez said she was defamed because of the similar name.  Investigators determined that there was no nanny and charged Anthony with murder.  Casey Anthony was eventually acquitted at trial of the most serious charges relating to her daughter’s disappearance and death.

Anthony’s lawyers write in their new motion that Gonzalez’s claim is based entirely on privileged conversations with law enforcement and out-of-context comments Anthony made to her mother.  Roy Kronk found Caylee Anthony’s remains near the Anthony home.  He claims he was defamed when Jose Baez made “false statements” about him.  Anthony’s attorneys argue that Kronk is suing based upon protected privileged comments made by Jose Baez.  Besides, under bankruptcy law, a person “cannot be liable for statements of someone else.”

“Over the years, many persons have pursued actions in which they sought to profit, one way or another, from Ms. Anthony’s ordeal,” her attorney, David Schrader, wrote in the motion, “All of the claimants have been rebuffed and turned away empty-handed, though most of them enjoyed their ‘fifteen minutes’ of fame while their claims were pending, which was the real objective.”

Charles Green, Anthony’s civil attorney and Debra Ferwerda Anthony’s lead bankruptcy attorney, said their client never willfully or maliciously defamed Kronk, a meter reader, or Gonzalez, both are required for a defamation lawsuit.

“Casey Anthony specifically says when asked by the police ‘Is this the Zenaida Gonzalez you are referring to?’ she says, ‘No, that’s not the same person.’  She’s not talking about that Zenaida Gonzalez.  Never was.  Kronk is suing on what Jose Baez said in his closing arguments.  He’s suing Casey for something her attorney said, which just can’t be done.  Plus, what is said in court is protected,” said Ferwerda.

Casey Anthony is set to be deposed by Zenaida Gonzalez’s attorneys, her attorneys told FOX35 on Thursday that they will likely file a motion for protective order until after November 5th, the date the federal judge is expected to rule on the motions to dismiss.  Texas Equusearch, another group civilly suing Anthony, may be nearing a settlement with her, according to a recent court filing.

“Casey Anthony’s civil lawyers said they were victorious on Friday in their fight against Texas EquuSearch, which is suing Casey for more than $100,000.

The search group said that’s how much they spent on searches after Casey claimed her daughter Caylee was alive and missing.

Casey’s civil lawyers convinced Circuit Judge Lisa Munyon to allow them to question EquuSearch founder Tim Miller under oath about the conversation he said he had with Casey.

Casey later claimed during her murder trial that Caylee had been dead all along, after drowning accidentally in the family swimming pool.

Casey’s lawyers want to grill Miller about his claim in his lawsuit that Casey told him Caylee was alive and asked him to find her.

But Casey’s lawyers claim Miller made several public statements to the contrary.

Volunteers came from all over the country to help EquuSearch look for Caylee, who won the hearts of people everywhere.

Casey claimed a nanny took off with Caylee, and even though Casey’s story was full of contradictions and changes, EquuSearch came to Central Florida twice to lead massive searches that cost more than $100,000.

Casey was acquitted.

“Every person who was present during this meeting when this conversation allegedly took place denies that it ever occurred and this involves others than just members of the Anthony family,” said Casey’s lawyer, Charles Greene.

The judge still hasn’t ruled on EquuSearch’s request to have a special master, or a lawyer who would serve as a referee for the deposition, since there is no judge present. “

Casey Responds To TE Questions. No & No…

Casey has now submitted her answers to both questions in relation to Tim Miller’s ongoing frivolous BS lawsuit.

The first question was whether GA had called 911 to report Caylee had drowned in the family pool. Casey said she did not observe any such call (and we know the reasons why GA couldn’t make the call too). The second question asked whether Casey was aware of the TE efforts to search for Caylee in September and October 2008. Casey said she was not aware that the searches were being conducted.

“Casey Anthony will have to answer two questions for Texas EquuSearch. Just two.

Judge Lisa Munyon ruled Tuesday that Anthony was still entitled to invoke the Fifth Amendment on many of the questions Texas EquuSearch wants to ask her as part of their lawsuit. The group is suing Anthony. They contend she wasted their money and resources because they say she knew all along her daughter was dead.

The judge did rule, however, that Anthony could be compelled to answer two “admissions”:

  • Admit that you did not observe or hear George Anthony call 911 at any time to report that he or you had discovered that Caylee Marie Anthony had drowned in the swimming poll at your parents’ house on or about June 16, 2008.
  • Admit that you were aware in September 2008 and October 2008 that EquuSearch was conducting searches for your daughter, Caylee.

She has 10 days to provide answers to these admissions.

Anthony was found guilty last July of four counts of lying to the Orange County Sheriff’s Office regarding her daughter’s death. Since she is appealing that conviction, her attorneys have long insisted that she cannot answer any questions until her appeals have been exhausted.”

Tim Miller denied — ZG and M&M jump on the video bandwaggon

In today’s hearing — Tim Miller’s protective order request was turned down, and he’ll now face a deposition (of up to 7 hours) in relation to his recent frivolous civil suit regarding his ongoing & misdirected “damages” claim against Casey.

Not to be outdone, ZG’s attorneys (Morgan & Morgan) have now jumped on the video bandwaggon and are gearing up to request the additional video & audio recordings Casey mentioned in her personal video diary. WTF that has to do with them is beyond me – and I doubt they’ll get very far. They’re also requesting the unsealing of Casey’s initial ZG video deposition.  Their time would be far better spent concentrating on what they’re really good at – i.e. being lousy attorneys for losers.

Lawyers for Casey Anthony are expecting to question Tim Miller, the head of Texas EquuSearch, in relation to the group’s lawsuit against Anthony – but, Miller’s lawyer says he won’t be here, despite a threat of contempt charges.

Miller’s lawyer said both sides had agreed to put off the deposition. He has filed an order of protection to delay Miller’s deposition, but the judge hasn’t ruled on it yet.

Miller was subpoenaed after arriving in Orlando to help with the search for missing mother Michelle Parker.

“Mr Miller is under subpoena,” said Charles Greene, attorney for Casey Anthony. “If he doesn’t show up in the morning we will seek an order holding him in contempt.”

The lawyer for EquuSearch says it would be unfair if his client is forced to give his deposition first.

Tim Miller’s lawyer was in court Monday, asking a judge to compel Casey Anthony to answer questions without invoking her Fifth Amendment rights. EquuSearch is suing Anthony to get back money spent searching for her daughter, Caylee Anthony. Miller says Anthony knew where the child was the entire time.

The judge in case is withholding her ruling.

In the never ending merry-go-round of lawsuit stupidity, this time it’s the return of Texas Equusearch as they continue in their attempts to recoup $100k from Casey. Good luck with that.

I’m still not sure why they’re not chasing the serial child abuser (and his enabler) for a share of the $500k they received from their Dr Phil BS interview a few months back. After all, they called Texas Equusearch out in the first place, even though they both knew damn well exactly where Caylee was. Let me know your thoughts.

The hearing is scheduled for 1-30 pm today at OC court house with Judge Lisa Munyon.


Texas EquuSearch join motion in ZG case

“A judge could rule as early as Thursday on a now joint motion from both of Casey’s civil lawsuits.

Monday morning, Judge Lisa Munyon allowed Texas EquuSearch founder Tim Miller to join the motion from Zenaida Gonzalez’s lawyers to decide if Casey should be forced to answer questions without invoking her Fifth Amendment right against self-incrimination.

Those questions will come from lawyers involved in EquuSearch’s and Gonzalez’s separate lawsuits against Casey.

Gonzalez is suing for defamation, saying Casey Anthony ruined her life when she claimed a nanny with the same name kidnapped her daughter, Caylee, in 2008.

EquuSearch wants Casey to repay them for the group’s search for Caylee, pointing to claims from Casey’s defense team during her murder trial that she knew her daughter was dead.

Casey is also appealing her four convictions of lying to law enforcement, and that could have a big impact on the judge’s decision Thursday, because anything she does say in a civil deposition can be used against her in the criminal appeal.

They said any answers could jeopardize her criminal appeal on charges of lying to law enforcement. A judge could decide Thursday whether Anthony will have to answer questions in Gonzalez’s lawsuit.”

Hot on the heels of Zenaida Gonzalez, it’s now the turn of  Texas Equusearch to join the frivolous civil suit circus.  Click here for the specifics.

They apparently want Casey to pay for their inability to find Caylee’s remains. If remember rightly, in November 2008 Texas Equusearch (and a bunch of other people to boot) searched the exact area where the remains were discovered – and found nothing… mainly due to Roy Kronk playing hide & seek with the remains in an attempt to secure himself the $255k reward money.

Here’s a segment from FOX News that aired on December 11th 2008 – the day “the remains” were found… but they had not yet been identified as Caylee’s, hence the continual “bag of bones” references. In this clip, Judge Andrew Napolitano covers the highly probable movement of Caylee’s remains prior to their ultimate discovery:
