Team Casey file appeal to dismiss LE charges

“Casey Anthony’s attorney Cheney Mason filed an appeal to dismiss the charges she faces for lying to law enforcement.

Casey’s lawyers filed an appeal with the Fifth District Court of Appeals in Daytona Beach which deals with the outstanding four counts Anthony was convicted of lying to law enforcement officers.

The appeal was filed around 1:30 p.m. In it, Casey Anthony’s lawyer, Cheney Mason, claimed Casey gave the statements in question to law enforcement officers in 2008 before she was even read her Miranda rights by any of Orange County Sheriff’s investigators. The court determined those statements were lies.

Mason also argued she should’ve been charged with only one count of lying to officers, not four counts. He said three of those counts are double jeopardy, since each count stems from the same single offense. Mason said her lawyers filed motions to suppress those statements during her trial, but those motions were denied. That is why Mason is appealing at the Fifth District Court of Appeals.

It was almost three years ago that Casey told Orange County deputies the following:

  • That she worked at Universal Orlando Resort in 2008,
  • That she left Caylee with a babysitter named Zenaida Gonzalez,
  • That she told Jeffrey Hopkins and Juliette Lewis that Caylee was missing
  • That she spoke to Caylee on the phone on July 15, 2008.

Casey was charged and convicted of a separate count for each statement. She was fined $1,000 for each count, totaling $4,618 after court costs. She was sentenced to one year of probation.”

  1. Why wasn’t this brought up in the trial? How could Cheney Mason have missed this? Forgive me but I don’t think too much of Cheney Mason anyway when he came out against Jose Baez. These lying charges are BS.

    • What would bringing it up doing trial have done. As long as each count was presentend separately for deliberation, the jurors would have had to rule on them separately. That’s if they were doing their job as instructed like we believe they were.

      Mr Mason didn’t miss anything….this WAS brought up at sentencing when they tried to convince IDIOT Perry this was double jeopardy.But just like most of Perrys rulings….all he could see was Casey was winning & he did not like that.Perry or any other judges made it real clear they thought Casey was GUILTY & they had no clue what all the evidence was & didn’t really care.They all had BLINDERS on! Remember the first judge was so BOLD & BIAS that he had to remove himself!

      • I remember it being brought up at sentencing too. Lisabeth Fryer argued for reducing the four counts to one count, if I’m not mistaken.

      Cheney Mason didn’t come out “against’ Baez. Speaking to law students, he made a point that attorneys shouldn’t make statements to a jury they can’t back up later with evidence. I don’t entirely
      agree with Mason, since Baez destroyed George Anthony’s credibility at the trial and that helped in
      Casey’s aquittal, but he made a valid point. Mason is a very old-school lawyer, one of the best, so it’s
      no surprise there were some disagreements with Jose, but between the two of them and the rest of
      the team they saved Casey’s life. And Mason is still aggressively representing her at court. In his own
      way, I think Jose is still advocating for her innocence, through his book. They’re both great lawyers.

      (Someone correct me if I am wrong), but I think it was brought up about the lying being double jeopardy, and the miranda rights issue, I think at a hearing. It seems I recall this being an issue. .

        Her lies were proof that her story was different than what unfolded and intentional destroyed her image; IMO The lies were part of the ‘murder story’, not what Casey knew, OR ‘believed’ from the time ‘her whole life’ and their belongings disappeared [were taken away] “in early-to-mid June”

  2. When and where did Mason say publicly that he did not agree with going after George or that George did not kill Caylee? I have seen this in the posts of two or three nonsupporters today?? What did I miss?
